These Terms and Conditions (“Terms”) govern your access to and use of Discover Urdu’s website, educational services, memberships, subscriptions, content, communications, events, applications, and related offerings (collectively, the “Services”).
“Discover Urdu” is operated by Descovr LLC, Massachusetts, USA, doing business as Discover Urdu, and is affiliated with Descovr Resources (Private) Limited, Pakistan. The use of the name “Discover Urdu” does not limit the educational subjects, languages, cultural programs, literacy instruction, religious literacy education, or other Services that Discover Urdu may offer from time to time.
By accessing our website, requesting information, requesting or participating in a trial lesson, requesting enrollment information, communicating with Discover Urdu regarding the Services, creating an account, enrolling a Learner, subscribing to a membership, purchasing Services, accessing or participating in the Services, or otherwise using the Services, you agree to be bound by these Terms.

Discover Urdu may designate additional Authorized Communication Channels from time to time. Communications submitted through any channel other than an Authorized Communication Channel may not be received, reviewed, processed, acted upon, acknowledged, or deemed effective. Discover Urdu shall have no responsibility for delays, misunderstandings, failures, or other consequences arising from communications submitted through unauthorized channels.
You must be at least eighteen (18) years old to purchase Services, create an account, establish a subscription, enter into agreements with Discover Urdu, or otherwise act on behalf of a Learner.
By enrolling a Learner, creating an account, purchasing Services, or otherwise acting as a Parent, you represent and warrant that you have the legal capacity and authority to do so.

The Services, and the manner in which they are provided, may vary over time.
Discover Urdu reserves the right, in its sole discretion, to modify, improve, suspend, discontinue, replace, restructure, update, expand, reduce, or otherwise alter any aspect of the Services at any time, with or without notice, including but not limited to curricula, lesson formats, programs, memberships, schedules, class sizes, technologies, platforms, materials, features, Educators, pricing, and methods of delivery.
Discover Urdu may conduct informal, observational, diagnostic, developmental, educational, performance-based, or other assessments as part of its educational methodology. The format, timing, frequency, visibility, disclosure, administration, interpretation, and use of such assessments shall be determined solely by Discover Urdu.
Discover Urdu reserves the right to determine and modify the placement of Learners into classes, groups, levels, cohorts, tracks, programs, or instructional arrangements based on age, ability, educational needs, availability, scheduling considerations, safeguarding considerations, behavioral considerations, operational requirements, staffing availability, and any other factors deemed relevant by Discover Urdu.
Discover Urdu does not guarantee the continued availability of any particular Educator, class, program, schedule, feature, group, cohort, lesson format, or instructional arrangement. Discover Urdu may assign, reassign, substitute, replace, or remove Educators and may modify schedules, class structures, or program offerings at its discretion.
Discover Urdu reserves the right to determine the instructional format through which Services are delivered.
Services may be provided through one-to-one instruction, paired instruction, small-group instruction, cohort-based learning, workshops, camps, seminars, presentations, asynchronous activities, self-directed learning resources, recorded content, hybrid learning arrangements, or other educational formats determined by Discover Urdu.
Discover Urdu reserves the right to modify instructional formats, class composition, group size, cohort structure, delivery methods, educational arrangements, lesson schedules, lesson duration, meeting frequency, program calendars, instructional timetables, and related educational components at any time based on educational considerations, enrollment levels, staffing availability, operational requirements, safeguarding considerations, scheduling needs, technological considerations, or other legitimate business reasons.
Unless expressly stated in a separate written agreement signed by an authorized representative of Discover Urdu, no Learner is guaranteed one-to-one instruction, a particular class size, a particular Educator, a specific schedule, a specific program structure, or a particular educational format.
Discover Urdu reserves the right to create, modify, combine, divide, dissolve, reorganize, suspend, discontinue, or reassign classes, cohorts, groups, instructional tracks, educational levels, program structures, schedules, and educational arrangements at any time based on educational considerations, enrollment levels, staffing availability, operational requirements, safeguarding considerations, scheduling needs, technological considerations, insufficient enrollment, or other legitimate business reasons.
Discover Urdu may assign, reassign, substitute, replace, remove, supervise, evaluate, manage, or otherwise change Educators at any time in its sole discretion. Discover Urdu does not guarantee the continued availability of any particular Educator, class, cohort, group, schedule, instructional arrangement, lesson format, program offering, or other aspect of the Services, and no Learner is guaranteed any of the foregoing for any particular period of time.
Discover Urdu may utilize, replace, modify, discontinue, or transition between educational platforms, communication systems, scheduling systems, learning management systems, video conferencing platforms, technology providers, or related service providers as part of its ongoing operations and service delivery.
No Learner is guaranteed continued participation in any particular class, cohort, group, schedule, instructional arrangement, educational level, program structure, or Educator assignment.
Discover Urdu may, at its sole discretion and subject to availability, offer trial sessions, consultations, evaluations, assessments, demonstrations, introductory meetings, or similar pre-enrollment activities.
The availability, format, duration, content, scheduling, Educator assignment, and eligibility criteria for any such activity shall be determined solely by Discover Urdu.
Participation in a trial session or similar activity does not guarantee admission, enrollment, placement, availability, Educator assignment, scheduling preferences, future participation, or access to any particular Service.
Discover Urdu reserves the right to decline, modify, postpone, discontinue, or limit trial sessions at any time.
Unless expressly stated otherwise in writing, trial sessions are provided for evaluation and introductory purposes only and may not reflect the exact format, Educator assignment, schedule, curriculum, class composition, instructional frequency, or experience of ongoing Services.
2.3 Enrollment Decisions
Discover Urdu reserves the right to accept, decline, postpone, restrict, condition, suspend, terminate, or refuse enrollment, participation, trial requests, waitlist requests, transfers, re-enrollment requests, or access requests for any lawful reason, including but not limited to capacity limitations, staffing limitations, scheduling limitations, educational considerations, behavioral concerns, safeguarding considerations, operational requirements, payment-related issues, compliance concerns, or other legitimate business reasons.
Placement on a waitlist does not guarantee future enrollment, timing of enrollment, Educator assignment, schedule availability, class placement, program admission, or access to any particular Service.
2.4 Educational Reports, Evaluations, and Updates
Discover Urdu may, but is not obligated to, provide progress reports, educational updates, observations, evaluations, recommendations, assessments, summaries, feedback, or similar communications regarding a Learner’s participation in the Services.
The timing, frequency, format, content, methodology, level of detail, availability, distribution, and recipients of any such reports, updates, assessments, evaluations, recommendations, summaries, feedback, or communications shall be determined solely by Discover Urdu and may vary among Learners, programs, membership plans, educational formats, Educators, Billing Cycles, or periods of participation.
Discover Urdu may provide reports, updates, assessments, evaluations, recommendations, summaries, feedback, or similar communications to the Learner, the Parent, and to any additional individual designated, authorized, or approved by the Parent. Discover Urdu may determine, in its sole discretion, which recipients receive particular communications and whether particular information is provided to a Learner, Parent, authorized recipient, or any combination thereof.
Discover Urdu may rely upon the authority, instructions, permissions, designations, representations, authorizations, recipient information, contact information, and delivery instructions provided by the enrolling Parent unless Discover Urdu receives documentation or information that reasonably requires a different course of action.
Parents are responsible for ensuring that all designated recipients, email addresses, contact information, permissions, and authorizations remain accurate, complete, current, authorized, and up to date. Discover Urdu shall not be responsible for disputes between Learners, parents, guardians, family members, caregivers, authorized recipients, or other individuals regarding access to educational information, reports, updates, assessments, evaluations, recommendations, summaries, feedback, or similar communications.
Discover Urdu may rely upon email addresses, contact information, recipient designations, delivery instructions, permissions, authorizations, and other information provided by a Parent, Learner, or authorized recipient. Discover Urdu shall not be responsible for non-delivery, delayed delivery, failed delivery, delivery to an incorrect recipient, delivery to an outdated recipient, filtering by spam or security systems, mailbox limitations, technical issues, misunderstandings regarding recipient designations, errors in contact information provided by others, or other communication issues arising from inaccurate, incomplete, outdated, ambiguous, misunderstood, miscommunicated, or unauthorized recipient information. Where Discover Urdu sends a communication in good faith to an email address or recipient reasonably believed to be authorized based upon information available to Discover Urdu at the time, such communication shall be deemed properly delivered for purposes of these Terms.
Discover Urdu reserves the right, in its sole discretion, to withhold, limit, modify, redact, delay, abbreviate, supplement, consolidate, suspend, replace, discontinue, or otherwise alter any report, update, assessment, evaluation, recommendation, summary, feedback, or similar communication at any time for operational, educational, administrative, staffing, safeguarding, technical, compliance, business, legal, wellbeing, or other legitimate reasons.
Discover Urdu may maintain, modify, archive, retain, delete, anonymize, consolidate, transfer, dispose of, or otherwise manage educational records, reports, observations, assessments, evaluations, recommendations, summaries, feedback, communications, and related materials in accordance with its policies, operational requirements, legal obligations, business practices, and educational methodologies.
Discover Urdu shall have no obligation to preserve, reproduce, restore, reissue, recreate, retrieve, or provide historical reports, educational records, observations, assessments, evaluations, recommendations, summaries, feedback, communications, or related materials after they have been modified, archived, anonymized, deleted, disposed of, or otherwise removed from active use.
Discover Urdu may organize, categorize, prioritize, summarize, abbreviate, consolidate, automate, standardize, or otherwise modify the manner in which educational information is recorded, maintained, communicated, presented, or delivered to Learners, Parents, or authorized recipients.
Educational reports, observations, assessments, evaluations, recommendations, summaries, feedback, and similar communications are provided solely for informational and educational purposes. Such communications do not constitute professional educational certification, academic accreditation, medical advice, psychological advice, therapeutic services, counseling services, legal advice, diagnostic services, or any other professional opinion or service.
Parents and Learners remain solely responsible for decisions made in reliance upon any report, update, observation, assessment, evaluation, recommendation, summary, feedback, communication, or other information provided by Discover Urdu.
The absence, delay, modification, reduction, inaccuracy, incompleteness, discontinuation, non-delivery, or failure to provide any report, update, assessment, evaluation, recommendation, summary, feedback, or similar communication shall not automatically entitle a Parent or Learner to refunds, credits, fee reductions, make-up sessions, extensions, compensation, cancellation rights, chargebacks, or any other remedy.
Discover Urdu retains all rights, title, and interest in and to its reporting formats, assessment methodologies, evaluation frameworks, observations, educational records, comments, recommendations, templates, and related materials.
Nothing in the Services obligates Discover Urdu to provide any minimum number of reports, updates, evaluations, assessments, recommendations, summaries, feedback, or communications during any Billing Cycle, membership period, enrollment period, or other period of participation.
The rights, discretions, limitations, protections, and obligations described in this Section shall survive the suspension, cancellation, expiration, termination, non-renewal, or conclusion of any enrollment, membership, subscription, Billing Cycle, educational program, or participation in the Services.
Certain Services may be offered through memberships, subscriptions, tuition plans, recurring billing arrangements, or other payment structures.
By purchasing a membership, subscription, or such Services, you authorize Discover Urdu and its payment processors to charge the payment method on file for all applicable fees, renewals, automatically recurring charges, taxes, upgrades, plan changes, adjustments, and other amounts authorized under these Terms. Such authorization shall remain in effect, may be recurring in nature, and shall apply to any replacement, updated, renewed, or successor payment method associated with the account until the applicable membership or subscription is cancelled in accordance with these Terms.
Subscriptions automatically renew unless cancelled in accordance with these Terms and any applicable cancellation procedures.
Discover Urdu reserves the right to modify pricing, plans, features, membership structures, subscription arrangements, billing arrangements, academic calendars, program formats, and related aspects of the Services from time to time.
Where reasonably practical, Discover Urdu will provide notice of material changes. Certain operational, administrative, scheduling, onboarding, billing-cycle, service-period, or program-management adjustments may occur without advance notice where reasonably necessary.
Membership fees secure a Learner’s enrollment and place within Discover Urdu’s limited-capacity educational program.
Each membership plan is designed around a target instructional schedule as described on Discover Urdu’s website and enrollment materials at the time of purchase.
Membership fees are charged for participation in and continued enrollment within the Discover Urdu program and access to Services. Membership fees are not earned, calculated, accrued, or refundable solely on the basis of the number of sessions conducted, attended, missed, rescheduled, interrupted, modified, or otherwise provided during any particular week, month, Billing Cycle, service period, enrollment period, or other period of time. Membership fees are not calculated solely on a per-class, per-session, per-hour, or attendance basis.
Where a membership plan references a target instructional frequency, including but not limited to two (2), three (3), or four (4) sessions per week, such frequency represents the intended structure of the program and not a guarantee that a specific number of sessions will occur during every calendar week, month, billing period, or other period of time.
Discover Urdu makes reasonable efforts to provide the instructional frequency associated with a selected membership plan. However, actual instructional frequency, scheduling, and availability may vary due to holidays, scheduled breaks, Educator availability, Learner availability, operational requirements, enrollment levels, safeguarding considerations, technical limitations, force majeure events, academic calendar adjustments, and other legitimate business reasons.
Temporary variations in scheduling, calendar structure, Educator assignments, closures, holidays, operational adjustments, or instructional frequency shall not automatically entitle a Parent or Learner to refunds, credits, fee reductions, make-up sessions, extensions, or other compensation unless expressly provided by Discover Urdu in writing.
Missed sessions, late arrivals, voluntary absences, vacations, travel, scheduling conflicts, personal commitments, extracurricular activities, illnesses, failures to attend, or other Learner-initiated interruptions shall not automatically reduce membership fees or entitle a Parent or Learner to refunds, credits, fee reductions, extensions, make-up sessions, cancellation rights, or other compensation unless expressly provided by Discover Urdu in writing.
Discover Urdu reserves the right to modify, restructure, combine, divide, rename, replace, discontinue, or otherwise administer membership plans, subscription structures, instructional tracks, academic calendars, scheduling systems, enrollment models, program formats, and related administrative frameworks as reasonably necessary to support the operation, development, improvement, compliance, or sustainability of the Services.
Discover Urdu may transition Learners between membership structures, billing arrangements, subscription models, academic calendars, scheduling systems, or administrative frameworks where reasonably necessary for operational, educational, technical, compliance, administrative, or business purposes.
Such changes shall not automatically entitle a Parent or Learner to refunds, credits, fee reductions, cancellation rights, or other compensation unless expressly provided by Discover Urdu in writing.
Membership billing may begin upon enrollment, purchase, or subscription activation.
Following enrollment, Discover Urdu may require a reasonable period of time to complete placement, scheduling, Educator assignment, onboarding, assessment, grouping, operational accommodations, or other administrative processes before a Learner begins participating in Services.
Discover Urdu does not guarantee that Services will commence immediately upon enrollment.
Where Discover Urdu determines that a Learner’s initial participation has been delayed due to scheduling, placement, operational accommodations, or other administrative reasons, Discover Urdu may adjust one or more future billing cycles, billing dates, renewal dates, service periods, enrollment periods, subscription periods, or other enrollment-related timing to account for the delayed start.
The timing and method of any such adjustment shall be determined solely by Discover Urdu.
Administrative onboarding, scheduling, placement activities, communications, assessments, and related enrollment processes may constitute Services for purposes of these Terms.
Enrollment, memberships, subscriptions, participation rights, and program placements are personal to the enrolled Learner and may not be shared, transferred, assigned, sublicensed, resold, or used by any other individual unless expressly authorized by Discover Urdu.
Discover Urdu reserves the right to suspend or terminate Services where unauthorized sharing or use is suspected.
Nothing in the Services creates any employment relationship, agency relationship, partnership, joint venture, fiduciary relationship, contractor relationship, representative relationship, custodial relationship, therapeutic relationship, counseling relationship, childcare relationship, medical relationship, supervisory relationship, or similar arrangement between any Covered Individual, Parent, Learner, and any Discover Urdu Educator.
Educators act solely on behalf of Discover Urdu in connection with the Services. Educators possess only such authority as Discover Urdu expressly grants as governed by Section 9.3 of these Terms. Additional provisions of Section 9.1, 9.2, 9.2A and 9.3 apply.
Payments are processed through third-party payment providers.
Discover Urdu does not directly store sensitive payment card information.
You agree to provide accurate, complete, and current payment information and authorize all charges associated with your purchases.
Parents are responsible for maintaining accurate, complete, current, and valid payment information. Parents must promptly update payment methods, billing information, contact information, and related account information as necessary to ensure successful processing of authorized charges. Discover Urdu shall not be responsible for service interruptions, suspensions, delays, enrollment impacts, or other consequences arising from inaccurate, expired, invalid, declined, restricted, or outdated payment information.
Memberships and subscriptions may automatically renew and rebill unless cancelled in accordance with these Terms.
Failure to maintain valid payment information or successful payment authorization may result in suspension or termination of Services.
Where payment is declined, reversed, disputed, blocked, delayed, interrupted, restricted, or otherwise unsuccessful for any reason, Discover Urdu may suspend, restrict, delay, reschedule, withhold, modify, or terminate access to Services until all outstanding amounts are resolved.
Discover Urdu may make reasonable attempts to reprocess authorized charges using the payment method on file.
Discover Urdu reserves the right to correct billing errors, administrative errors, pricing errors, or processing errors and to issue corresponding adjustments where appropriate.
Discover Urdu reserves the right to establish, modify, align, consolidate, extend, shorten, suspend, restart, or otherwise adjust billing cycles, billing dates, renewal dates, service periods, subscription periods, enrollment periods, and membership structures as reasonably necessary for operational, administrative, educational, technical, scheduling, accounting, compliance, enrollment-management, program-management, service-delivery, or business purposes.
Without limiting the foregoing, Discover Urdu may adjust billing dates, renewal dates, service periods, or billing cycles in connection with:
Initial enrollment and onboarding;
Delayed program starts;
Approved pauses;
Schedule changes;
Educator availability;
Service interruptions;
Makeup sessions;
Operational accommodations;
Academic calendar adjustments;
Program restructuring; or
Other legitimate business reasons.
Where reasonably practical, Discover Urdu will provide notice of material billing adjustments. Such adjustments shall not constitute grounds for refunds, cancellation, fee reductions, chargebacks, or other compensation.
Billing adjustments made in good faith to account for Services provided, delayed starts, missed instructional time, approved accommodations, or operational requirements shall not be deemed overbilling, unauthorized billing, or billing errors.
Billing cycles, renewal dates, service periods, enrollment periods, and subscription periods may be extended, shortened, suspended, restarted, delayed, consolidated, realigned, or otherwise modified by Discover Urdu in connection with force majeure events, operational disruptions, service interruptions, program restructuring, onboarding delays, approved pauses, educational considerations, administrative requirements, or other circumstances contemplated by these Terms.
Parents agree to make reasonable efforts to resolve billing concerns directly with Discover Urdu through an Authorized Communication Channel in accordance with Section 9.1 of these Terms before initiating chargebacks, payment disputes, payment reversals, or similar actions through financial institutions or payment providers.
Payment disputes, chargebacks, payment reversals, failed payments, and related matters are governed by Section 23 of these Terms.
Unless otherwise stated in writing:
Fees paid are non-refundable.
Partial billing periods are not refundable.
Missed classes, unused Services, unused portions of memberships, Learner absences, vacations, scheduling conflicts, or non-participation generally do not qualify for refunds.
Discover Urdu may, but is not obligated to, provide refunds, credits, adjustments, accommodations, extensions, make-up opportunities, or other remedies in exceptional circumstances at its sole discretion.
Nothing in these Terms limits any mandatory consumer rights that may apply under applicable law.
The existence of a dispute, dissatisfaction with educational progress, Educator changes, scheduling adjustments, holiday closures, or operational modifications does not automatically create a right to a refund, credit, fee reduction, or other compensation unless expressly provided by Discover Urdu in writing.
Any refund, credit, adjustment, accommodation, extension, make-up opportunity, or other remedy approved by Discover Urdu shall be provided in the form, amount, method, timeframe, and manner determined by Discover Urdu and may be subject to administrative processing requirements, payment-provider limitations, verification procedures, operational considerations, or other reasonable conditions.
Learners are expected to attend scheduled sessions on time and prepared to participate.
Discover Urdu may occasionally reschedule, modify, postpone, combine, cancel, or otherwise adjust classes due to Educator availability, operational requirements, holidays, emergencies, technical issues, safeguarding concerns, enrollment considerations, or circumstances beyond our reasonable control.
Educator assignments are subject to change in accordance with Section 2.1 of these Terms.
Educator substitutions, staffing changes, or personnel decisions shall not constitute grounds for cancellation, refund, credit, termination, or claims against Discover Urdu.
Discover Urdu may observe holidays, breaks, closures, professional development days, administrative days, religious observances, national holidays, emergency closures, and other periods during which Services may be unavailable or modified.
Discover Urdu generally follows an academic calendar that may substantially align with public holidays and observances in Pakistan. Any published calendar, schedule, PDF, announcement, notice, or holiday listing is provided for informational purposes only and may be modified, supplemented, suspended, replaced, or withdrawn at any time, including on short or no notice where reasonably necessary.
Membership fees remain payable during holidays, closures, scheduled breaks, and unscheduled interruptions.
Sessions not conducted due to holidays, closures, calendar adjustments, operational requirements, Educator availability, or similar circumstances shall not automatically entitle a Parent or Learner to refunds, credits, make-up sessions, extensions, fee reductions, or other compensation unless expressly provided by Discover Urdu in writing.
Discover Urdu may, at its sole discretion, attempt to accommodate schedule change requests.
Schedule change requests must be submitted through an Authorized Communication Channel in accordance with Section 9.1 of these Terms.
Requests should generally be submitted at least seventy-two (72) hours before the affected session or proposed effective date of the requested change. However, to minimize disruption and maximize the likelihood that suitable scheduling alternatives can be identified, coordinated, and implemented, Discover Urdu recommends submitting schedule change requests at least ten (10) days in advance whenever reasonably possible.
Discover Urdu generally requires a minimum processing period of seventy-two (72) hours to review, coordinate, and implement approved schedule changes. Processing times may be extended due to weekends, holidays, office closures, Educator availability, staffing considerations, operational requirements, safeguarding considerations, or other relevant circumstances.
Approval of schedule changes is not guaranteed and remains subject to Educator availability, program capacity, operational requirements, safeguarding considerations, curriculum needs, scheduling availability, coordination requirements, availability of suitable alternatives, and other relevant factors.
Discover Urdu may require additional time to identify, evaluate, coordinate, negotiate, confirm, or implement suitable scheduling arrangements, alternative placements, Educator assignments, or other accommodations. Discover Urdu does not guarantee that a requested schedule change can be accommodated within any particular timeframe.
A schedule change shall not be considered approved unless expressly confirmed by Discover Urdu.
The inability to accommodate a requested schedule change shall not constitute grounds for refunds, credits, fee reductions, make-up sessions, cancellation, termination, or other compensation.
This Section applies to requests to modify a Learner’s ongoing schedule and does not govern requests relating solely to an individual instructional session, which are addressed in Section 6.3.
6.3 Individual Session Cancellation and Rescheduling Requests
Parents may request the cancellation or rescheduling of an individual instructional session by submitting a request through an Authorized Communication Channel in accordance with Section 9.1 of these Terms.
Requests should generally be submitted at least seventy-two (72) hours before the scheduled session. However, requests submitted during weekends, holidays, office closures, staffing interruptions, or other periods during which Discover Urdu is not reasonably able to process requests may require additional notice. To maximize the likelihood that suitable arrangements can be identified and implemented, Discover Urdu recommends submitting requests at least ten (10) days in advance whenever reasonably possible.
Discover Urdu may, at its sole discretion, approve or decline requests to cancel or reschedule individual instructional sessions. Approval is not guaranteed and remains subject to Educator availability, scheduling availability, operational requirements, safeguarding considerations, curriculum needs, program structure, and other relevant factors.
A request to cancel or reschedule an individual session shall not be considered approved unless expressly confirmed by Discover Urdu in writing.
Approval of a request to cancel an individual session does not constitute approval of a rescheduling request, does not create any entitlement to a replacement or make-up session, and does not obligate Discover Urdu to provide substitute instructional time or any other accommodation unless Discover Urdu expressly agrees otherwise in writing.
Where Discover Urdu approves a rescheduling request or elects to provide a replacement session, make-up session, or other accommodation, the timing, format, Educator assignment, availability, and other arrangements shall be determined by Discover Urdu.
The inability or decision not to accommodate a requested cancellation or rescheduling shall not automatically entitle a Parent or Learner to refunds, credits, fee reductions, make-up sessions, service extensions, cancellation rights, or other compensation.
Unless otherwise communicated by Discover Urdu, instructional sessions are generally designed to be approximately thirty (30) minutes in duration.
Session lengths may vary based on Learner needs, program requirements, scheduling considerations, operational factors, Educator discretion, or other circumstances determined by Discover Urdu.
Occasional extensions, reductions, interruptions, or adjustments to session length shall not constitute grounds for refunds, credits, fee reductions, make-up sessions, or other compensation.
Learners are expected to attend scheduled sessions promptly at the scheduled start time.
Where a Learner joins after the scheduled start time, Discover Urdu is not obligated to extend the session beyond its scheduled end time in order to accommodate the late arrival.
Discover Urdu reserves the right to conclude a session and mark a Learner absent if the Learner has not joined within fifteen (15) minutes of the scheduled session start time.
If a Learner joins after a session has been concluded due to non-attendance, Discover Urdu shall have no obligation to restart, extend, reschedule, repeat, or otherwise provide the missed session.
Notification of an absence, or approval of a request to cancel an individual session, shall not by itself constitute approval of a rescheduling request or create any entitlement to a replacement or make-up session.
Covered Individuals, Parents and Learners are responsible for providing and maintaining an appropriate learning environment, including reliable internet access, compatible devices, functioning audio and video equipment, appropriate software, and a reasonably distraction-free setting suitable for participation in the Services.
Discover Urdu shall not be responsible for missed instructional time, interruptions, delays, reduced participation, communication difficulties, or other impacts resulting from technical issues, connectivity issues, equipment failures, environmental distractions, or other circumstances occurring on the Learner’s side.
Late arrivals, missed sessions, scheduling conflicts, technical issues on the Learner’s side, failures to join within the required attendance window, vacations, or other Learner-initiated absences do not automatically entitle the Learner or Parent to refunds, credits, make-up sessions, fee reductions, or other compensation.
Discover Urdu may occasionally be unable to provide a scheduled session, may provide a modified session, may provide Services through an alternative Educator or format, or may otherwise adjust Services due to Educator availability, technical issues, connectivity issues, platform failures, staffing changes, scheduling conflicts, operational requirements, safeguarding considerations, emergencies, force majeure events, or other circumstances affecting Discover Urdu’s ability to provide Services.
Where such circumstances occur, Discover Urdu may, at its sole discretion, provide a substitute Educator, rescheduled session, make-up session, billing adjustment, service extension, account credit, alternative educational arrangement, or other accommodation.
Any accommodation, adjustment, remedy, or alternative arrangement provided by Discover Urdu is discretionary and shall not be guaranteed.
The remedies described in this section are examples of accommodations that Discover Urdu may elect to provide and shall not create an obligation to provide any particular remedy, accommodation, adjustment, credit, extension, replacement session, make-up session, or other compensation in any specific circumstance.
The nature, timing, availability, and appropriateness of any accommodation shall be determined solely by Discover Urdu.
Without limiting any other provision of these Terms, Discover Urdu may determine that no accommodation, adjustment, remedy, credit, extension, replacement session, make-up session, billing adjustment, or other compensation is appropriate in a particular circumstance.
Except as expressly required by applicable law or expressly agreed by Discover Urdu in writing, session interruptions, cancellations, modified sessions, staffing changes, technical issues, connectivity issues, operational adjustments, or similar circumstances shall not automatically entitle a Parent or Learner to refunds, credits, fee reductions, billing adjustments, chargebacks, cancellation rights, make-up sessions, replacement sessions, or other compensation.
Discover Urdu may, at its sole discretion, permit temporary pauses in membership billing and participation.
Pause requests must be submitted through an Authorized Communication Channel in accordance with Section 9.1 of these Terms and shall not be considered effective unless confirmed by Discover Urdu in writing.
Pause requests are subject to review, processing, scheduling, staffing, administrative, and operational considerations. Discover Urdu generally requires advance notice and reasonable processing time before an approved pause may take effect. Requests submitted on short notice, during holidays, closures, non-working periods, staffing interruptions, or other periods during which Discover Urdu is not reasonably able to process requests may require additional time.
Approved pauses shall take effect only on or after the date expressly approved by Discover Urdu in writing. Retroactive pauses are not permitted. Pauses shall not affect fees, charges, billing periods, memberships, Services, attendance records, or obligations that accrued before the approved effective date of the pause.
During an approved pause, a Learner’s participation in the program may be suspended and billing may be temporarily paused in accordance with any policies then in effect.
An approved pause does not guarantee preservation of a Learner’s place in the program, class assignment, cohort, Educator assignment, schedule, time slot, instructional track, level placement, personal accommodation or any other aspect of the Learner’s enrollment.
Time spent on an approved pause shall not automatically extend prior promotional pricing, discounts, grandfathered pricing, special enrollment terms, legacy membership structures, or other time-sensitive benefits unless expressly approved by Discover Urdu in writing.
Discover Urdu reserves the right to fill, reassign, or otherwise utilize any enrollment capacity made available during a pause.
Upon returning from a pause, a Learner may be assigned to a different Educator, class, cohort, schedule, instructional track, level, or program placement based on availability and operational requirements at the time of re-enrollment.
Discover Urdu may require reasonable onboarding, reassessment, scheduling, placement, administrative processing, Educator assignment, or other preparatory activities before a Learner resumes participation following a pause.
If suitable availability does not exist when a Learner seeks to return from a pause, Discover Urdu may place the Learner on a waiting list until an appropriate placement becomes available.
Parents may request cancellation of a membership by providing notice to Discover Urdu at least one hundred twenty (120) hours before the end of the current Billing Cycle.
Cancellation requests are subject to review and processing by Discover Urdu and should allow sufficient time for administrative handling before the end of the applicable Billing Cycle.
Requests submitted during holidays, closures, weekends, non-working periods, office shutdowns, staffing interruptions, or other periods during which Discover Urdu is not reasonably able to review and process requests may require additional processing time.
Cancellation requests received less than one hundred twenty (120) hours before the end of the current Billing Cycle, or received without sufficient time for reasonable processing by Discover Urdu, may not take effect until the following Billing Cycle.
Cancellation requests shall not be considered effective unless submitted in accordance with Section 9.1 of these Terms and received and acknowledged by Discover Urdu through an Authorized Communication Channel.
The Parent is responsible for ensuring that a cancellation request is submitted sufficiently in advance to permit timely review and processing. Failure to receive an acknowledgment from Discover Urdu should not be interpreted as confirmation that a cancellation request has been received, approved, or processed.
Discover Urdu may request additional information, identity verification, account verification, clarification, or confirmation before processing a cancellation request where reasonably necessary.
Membership fees already billed, accrued, due, authorized, or scheduled for processing for the current Billing Cycle are generally non-refundable and remain payable notwithstanding a cancellation request.
Cancellation does not relieve a Parent of fees, charges, obligations, or amounts that accrued before the effective cancellation date.
Initiation of a chargeback, payment dispute, payment reversal, cancellation of a payment method, revocation of payment authorization, refusal of payment, or similar action shall not constitute valid cancellation of a membership, subscription, enrollment, recurring billing authorization, or any obligation under these Terms.
Cancellation becomes effective at the end of the applicable Billing Cycle and does not entitle a Parent or Learner to a prorated refund, partial refund, fee reduction, service extension, make-up session, credit, or other compensation.
Cancellation of a membership does not guarantee future availability of the same Educator, schedule, class assignment, instructional track, level placement, program placement, pricing structure, promotional terms, membership plan, or enrollment status if the Learner later seeks to re-enroll.
Following cancellation, Discover Urdu may require reassessment, onboarding, schedule coordination, Educator reassignment, placement review, waitlist placement, or other administrative processes before a Learner may resume participation in the Services.
Participation in the Services requires suitable internet access, devices, software, hardware, accounts, communication tools, and related technology.
Covered Individuals, Learners and Parents are solely responsible for obtaining, maintaining, updating, configuring, securing, and operating all equipment, internet services, software, applications, accounts, usernames, passwords, licenses, permissions, and other resources necessary to access and participate in the Services.
Covered Individuals, Parents and Learners are responsible for providing and maintaining a suitable learning environment, including reliable internet connectivity, compatible devices, functioning audio and video equipment, appropriate software, and a reasonably distraction-free setting conducive to participation in the Services.
Discover Urdu may utilize third-party platforms, communication systems, scheduling systems, learning management systems, video conferencing services, software providers, hosting providers, technology vendors, and other service providers in connection with the Services. Discover Urdu does not control and is not responsible for the availability, performance, security, functionality, policies, actions, omissions, or decisions of such third-party providers.
Discover Urdu is not responsible for interruptions, delays, degraded performance, communication failures, access limitations, loss of connectivity, reduced functionality, or other issues caused by:
Internet outages or connectivity issues;
Device failures or equipment malfunctions;
Third-party platform failures or service disruptions;
Software incompatibilities or configuration issues;
User technical issues or user error;
Power outages;
Cybersecurity incidents affecting third-party providers;
Telecommunications failures;
Maintenance activities;
Capacity limitations;
Service-provider disruptions; or
Circumstances beyond Discover Urdu’s reasonable control.
Technical issues may arise on the Learner’s side, the Parent’s side, an Educator’s side, Discover Urdu’s side, a third-party provider’s side, or any combination thereof. In some circumstances, the source, cause, responsibility, or impact of a technical issue may be uncertain, disputed, indeterminable, difficult to verify, or not reasonably capable of being conclusively established.
Technical difficulties experienced by a Learner, Parent, Educator, authorized recipient, device, internet service provider, network, software application, third-party platform, communication system, scheduling system, hosting provider, technology vendor, or other technology resource do not automatically entitle the Learner or Parent to refunds, credits, fee reductions, make-up sessions, replacement sessions, extensions, billing adjustments, cancellation rights, chargebacks, or other compensation.
Where technical issues affect a scheduled session, regardless of whether the issue originates with a Learner, Parent, Educator, Discover Urdu, a third-party provider, or another source, Discover Urdu may, but is not obligated to, provide a substitute session, alternative Educator, alternative delivery method, make-up session, billing adjustment, credit, service extension, or other accommodation.
Discover Urdu shall have sole discretion to assess, investigate, evaluate, characterize, and respond to technical issues affecting the Services and to determine whether any accommodation, adjustment, alternative arrangement, make-up session, billing adjustment, credit, extension, or other remedy is appropriate under the circumstances.
Any accommodation, adjustment, remedy, credit, extension, make-up session, replacement session, alternative delivery method, or other arrangement provided by Discover Urdu is discretionary and shall not create an obligation to provide the same or similar accommodation in future circumstances.
Discover Urdu does not guarantee uninterrupted availability, error-free operation, continuous connectivity, compatibility with any particular device or software configuration, uninterrupted access to any website, platform, communication system, scheduling system, learning management system, or other technology used in connection with the Services, or that any technical issue will be identified, diagnosed, resolved, or remedied within any particular timeframe.
Covered Individuals, Parents and Learners agree to:
Provide accurate, complete, current, and truthful information;
Maintain account security, confidentiality, and control of account credentials;
Use the Services lawfully, responsibly, and in accordance with these Terms;
Respect Educators, staff members, contractors, representatives, and other Learners;
Follow reasonable instructions relating to participation in the Services;
Refrain from disruptive, abusive, threatening, harassing, discriminatory, inappropriate, dishonest, fraudulent, or unlawful conduct;
Maintain appropriate devices, internet connectivity, software, workspace conditions, supervision (where appropriate), and other resources reasonably necessary to participate in the Services;
Cooperate reasonably with Discover Urdu in connection with scheduling, attendance matters, educational planning, safeguarding, communications, account administration, billing matters, compliance reviews, investigations, dispute resolution, and the administration of the Services.
Parents remain responsible for supervising minor Learners as appropriate.
Conduct inconsistent with these Terms may result in action under Section 28, including suspension, restriction, refusal of participation, or termination.
For safeguarding, privacy, quality assurance, operational, educational, compliance, and security reasons, Discover Urdu may restrict communications between Covered Individual, Parents, Learners, Educators, and staff to approved Discover Urdu platforms and communication channels.
The communication requirements contained in this Section apply throughout these Terms unless a different procedure is expressly stated by Discover Urdu in writing.
Unless Discover Urdu expressly communicates otherwise in writing, only communications sent through or received from a valid Discover Urdu email address ending in “@discoverurdu.com” shall constitute an Authorized Communication Channel.
Discover Urdu may designate, modify, replace, restrict, suspend, or discontinue Authorized Communication Channels from time to time.
Covered Individuals, Parents and Learners shall use Authorized Communication Channels for all official notices, requests, approvals, cancellations, pause requests, schedule changes, billing matters, disputes, complaints, and other communications requiring action by Discover Urdu.
Communications submitted through any channel other than an Authorized Communication Channel may not be received, reviewed, processed, acted upon, or deemed effective. Discover Urdu shall have no responsibility for delays, misunderstandings, missed requests, failed cancellations, unprocessed schedule changes, unresolved disputes, communication failures, or other consequences arising from communications submitted through unauthorized channels.
Electronic acceptance, electronic communications, electronic acknowledgements, and electronic records shall have the same force and effect as physical signatures and written records.
The communication requirements contained in this Section apply throughout these Terms unless Discover Urdu expressly provides otherwise in writing. Without limiting the foregoing, the provisions governing unauthorized communications and circumvention (Section 9.2), Educator non-solicitation and direct engagement (Section 9.2A), and reliance on communications and the authority of Educators and staff members (Section 9.3) supplement and form part of this communications framework.
Discover Urdu’s safeguarding, privacy, quality assurance, operational, compliance, and supervision procedures require that communications between Covered Individual, Parents, Learners, Educators, and staff occur only through Authorized Communication Channels and approved Discover Urdu platforms.
Covered Individuals, Parents and Learners shall not request, solicit, exchange, distribute, publish, transmit, disclose, or attempt to obtain personal contact information relating to any Educator, staff member, Learner, Parent, Covered Individual, contractor, representative, or affiliate of Discover Urdu.
This includes, but is not limited to:
Personal email addresses;
Personal telephone numbers;
Messaging application accounts;
Social media accounts;
Home addresses; and
Any other personal contact information.
Covered Individuals, Parents and Learners shall not attempt to communicate with Educators or staff members through personal accounts, personal devices, social media platforms, messaging applications, or other communication channels not expressly authorized by Discover Urdu.
Covered Individuals, Parents and Learners shall not directly or indirectly recruit, solicit, employ, contract with, engage, refer work to, introduce work to, or otherwise establish educational, instructional, language-learning, tutoring, literacy, consulting, employment, contractor, business, or professional relationships with any Educator, contractor, employee, or representative introduced through Discover Urdu except through Discover Urdu.
Covered Individuals, Parents and Learners shall not, directly or indirectly, engage in conduct intended to bypass, avoid, circumvent, interfere with, compete unfairly with, or undermine Discover Urdu’s business relationships, enrollment processes, billing arrangements, Educator assignments, communication policies, safeguarding procedures, supervision requirements, operational controls, educational programs, service-delivery systems, confidential information, goodwill, or business opportunities. Without limitation, Covered Individuals, Parents and Learners shall not use, assist in the use of, or facilitate the use of Discover Urdu’s Educators, staff members, contractors, representatives, curriculum, operational systems, confidential information, business relationships, or other resources to establish, support, expand, promote, or operate any educational, tutoring, consulting, language-learning, or similar business or competing enterprise, whether directly or indirectly or through any third party.
Violations of this Section may result in action under Section 28 of these Terms, including suspension, restriction, refusal of participation, termination, denial of future enrollment, and other available remedies.
Discover Urdu reserves the right to permanently remove a Covered Individual, Parent, Learner, or account from the program, subject to applicable law and any rights expressly provided elsewhere in these Terms, where Discover Urdu determines, in its sole discretion, that such conduct presents a safeguarding concern, privacy risk, operational risk, security concern, conflict of interest, compliance concern, or violation of these Terms.
Without limiting the general prohibitions contained in Section 9.2, the following additional restrictions apply with respect to Discover Urdu Educators.
Covered Individuals, Parents and Learners shall not, directly or indirectly, during participation in the Services and for twenty-four (24) months following the termination, cancellation, suspension, expiration, or conclusion of such participation, solicit, recruit, hire, employ, contract with, engage, refer business to, receive educational, tutoring, instructional, consulting, mentoring, advisory, or other professional services from, or otherwise establish or attempt to establish any educational, commercial, employment, contractor, business, or professional relationship outside of Discover Urdu with any current or former Discover Urdu Educator, contractor, employee, staff member, representative, or affiliate whom they became aware of, interacted with, or were introduced to through Discover Urdu.
Discover Urdu reserves the right to suspend or terminate Services, deny future enrollment, seek temporary, preliminary, or permanent injunctive relief, equitable relief, monetary damages, recovery of losses, recovery of profits or other monetary remedies to the extent permitted by applicable law, recovery of reasonable investigation costs, enforcement costs, legal fees where recoverable, and any other remedies available at law or in equity in connection with violations of this Section. Covered Individuals, Parents and Learners acknowledge that violations of this Section may cause substantial and irreparable harm to Discover Urdu, the extent of which may be difficult to quantify, and agree that equitable relief may be appropriate in addition to any other available remedies.
Covered Individual, Parents and Learners acknowledge and agree that Educators and staff members possess only such authority as Discover Urdu expressly grants and may not have authority to modify these Terms, grant exceptions, approve refunds, alter billing obligations, modify memberships, approve cancellations, approve pauses, waive policies, create contractual obligations, or otherwise bind Discover Urdu unless expressly authorized to do so.
Covered Individual, Parents and Learners shall not rely upon any verbal statement, informal communication, assumption, expectation, estimate, prediction, representation, promise, assurance, accommodation, approval, authorization, commitment, exception, waiver, or other communication that conflicts with these Terms or that has not been confirmed through an Authorized Communication Channel by an individual expressly authorized by Discover Urdu to bind the organization. Any such communication shall be non-binding unless so confirmed.
No Educator, contractor, support representative, coordinator, administrator, customer-service representative, or other staff member shall have authority to modify these Terms, grant exceptions, approve refunds, alter billing obligations, modify memberships, approve cancellations, approve pauses, waive policies, create contractual obligations, make binding commitments, or otherwise bind Discover Urdu unless such action is expressly approved in writing through an Authorized Communication Channel by a Director, executive officer, or another individual expressly authorized by Discover Urdu to do so.
Discover Urdu provides Services to both minor and adult Learners.
Where a Learner is under eighteen (18) years of age, a Parent is responsible for authorizing participation and remains responsible for decisions relating to the Learner’s participation, wellbeing, supervision, conduct, safety, and compliance with these Terms.
Parents are responsible for determining whether the Services are appropriate for a Learner and for monitoring the Learner’s participation as the Parent deems appropriate.
Discover Urdu may require parental attendance, participation, supervision, assistance, or availability during any session involving a minor Learner where Discover Urdu determines such involvement is appropriate for educational, behavioral, safeguarding, operational, safety, or other legitimate reasons.
Parents remain responsible for ensuring that minor Learners are able to access scheduled sessions, utilize required technology, participate appropriately, and comply with applicable instructions, policies, and participation requirements.
Discover Urdu reserves the right to suspend, restrict, modify, postpone, terminate, or refuse participation where Discover Urdu determines that a Learner’s participation is inconsistent with the educational objectives of the Services, safeguarding considerations, operational requirements, behavioral expectations, safety considerations, or these Terms.
Discover Urdu provides educational services only and does not provide childcare, babysitting, supervision, therapy, counseling, psychological services, psychiatric services, behavioral intervention services, social services, caregiving services, medical services, healthcare services, emergency services, crisis intervention services, or similar services.
Participation in the Services does not create any custodial, supervisory, caregiving, therapeutic, counseling, medical, healthcare, fiduciary, guardian, or special-duty relationship between Discover Urdu and any Learner or Parent.
Parents remain solely responsible for supervision, safety, wellbeing, medical needs, behavioral needs, emotional support, transportation, caregiving decisions, emergency response, and all other responsibilities relating to a Learner outside the educational instruction expressly provided through the Services.
Discover Urdu is not responsible for monitoring a Learner outside scheduled educational interactions, ensuring a Learner’s safety outside the scope of educational instruction, supervising a Learner’s activities outside scheduled sessions, or responding to emergencies occurring outside Discover Urdu’s direct educational activities.
Nothing in the Services should be interpreted as creating an obligation on the part of Discover Urdu to provide childcare, supervision, caregiving, therapy, counseling, medical services, crisis intervention, emergency response, or similar services.
All curriculum, lesson materials, class content, recordings, graphics, logos, branding, videos, documents, worksheets, assessments, presentations, software, educational resources, educator guides, training materials, and related materials are owned by or licensed to Discover Urdu and are protected by applicable intellectual property laws.
Except as expressly permitted by Discover Urdu in writing, no content may be copied, reproduced, modified, distributed, published, transmitted, displayed, sold, licensed, reverse engineered, commercially exploited, or otherwise used beyond its intended educational purpose.
Covered Individuals, Parents and Learners shall not use, upload, submit, incorporate, reproduce, process, analyze, train, fine-tune, develop, improve, test, validate, or otherwise utilize any Discover Urdu content, curriculum, lesson materials, recordings, assessments, educational resources, communications, or proprietary information in connection with any artificial intelligence system, machine learning system, large language model, automated training system, data-mining activity, or similar technology without Discover Urdu’s prior written consent.
Access to or participation in the Services grants a limited, revocable, non-transferable, non-exclusive license to access and use Discover Urdu materials solely for the Learner’s personal educational use.
All rights not expressly granted are reserved by Discover Urdu.
Covered Individuals, Parents and Learners acknowledge that Discover Urdu’s educational methodologies, curriculum structures, curricula, assessments, lesson plans, educator training materials, educator guides, internal procedures, business processes, operational systems, learner placement methods, quality assurance processes, safeguarding procedures, recordings, educational records, technology systems, communications, pricing structures, and other non-public materials may constitute valuable proprietary information, trade secrets, and intellectual property of Discover Urdu.
The obligations contained in this Section apply to Covered Individuals, Parents, and Learners regardless of whether a Learner is ultimately enrolled, Services are purchased, an account is created, a trial lesson occurs, or an ongoing educational relationship with Discover Urdu is established.
Any non-public information disclosed by Discover Urdu, whether intentionally or inadvertently, shall be considered confidential information unless expressly designated otherwise by Discover Urdu in writing.
Confidential information may be disclosed by Discover Urdu before, during, or after enrollment, including through website content, enrollment inquiries, consultations, demonstrations, trial lessons, scheduling discussions, assessments, onboarding activities, communications, presentations, educational materials, or other interactions with Discover Urdu.
Covered Individuals, Parents and Learners agree not to:
Copy, reproduce, distribute, publish, disclose, transmit, sell, license, reverse engineer, adapt, modify, or exploit confidential information;
Share confidential information with third parties;
Use confidential information for any purpose other than participation in Discover Urdu Services;
Create competing educational materials, programs, services, curricula, assessments, training systems, or business operations based upon confidential information obtained from Discover Urdu;
Circumvent Discover Urdu by directly or indirectly soliciting, recruiting, hiring, contracting with, engaging, employing, referring, introducing, or otherwise establishing educational, commercial, professional, or business relationships with Discover Urdu Educators, contractors, employees, staff members, representatives, or affiliates outside of Discover Urdu without Discover Urdu’s prior written consent.
Covered Individuals, Parents and Learners shall not engage in conduct prohibited by Section 9.2A, which is incorporated into this Section by reference.
Covered Individuals, Parents and Learners shall not assist, encourage, facilitate, or permit any third party to engage in conduct that would violate this section if performed directly by the Covered Individual, Parent or Learner.
Covered Individuals, Parents and Learners further agree not to disclose, distribute, publish, upload, share, transmit, sell, or otherwise make available any recordings, screenshots, educational materials, assessments, reports, communications, learner information, educator information, internal documentation, or other materials obtained through Discover Urdu except as expressly authorized in writing.
Covered Individuals, Parents and Learners shall not analyze, deconstruct, map, document, replicate, emulate, benchmark, reverse engineer, derive, recreate, or attempt to recreate Discover Urdu’s educational methodologies, instructional frameworks, curriculum architecture, curricula, assessment systems, operational processes, educator training systems, quality assurance procedures, or business operations for commercial, competitive, organizational, educational, consulting, or business purposes.
Covered Individuals, Parents and Learners further agree not to use, directly or indirectly, any confidential information, proprietary information, operational knowledge, business methods, educational methodologies, curriculum structures, curricula, training materials, pricing information, business relationships, or other non-public information obtained through Discover Urdu to establish, support, expand, promote, or operate any educational, tutoring, consulting, language-learning, or similar business or competing enterprise, or to assist any other person or entity in doing so.
Covered Individuals, Parents, and Learners shall not directly or indirectly use, assist in the use of, or permit the use of confidential information, proprietary information, operational knowledge, business methods, curriculum structures, educational methodologies, staffing models, pricing information, business relationships, scheduling systems, quality assurance processes, or other non-public information obtained from Discover Urdu to establish, support, expand, promote, or operate any educational, tutoring, language-learning, cultural education, literacy, consulting, or similar business or competing enterprise, or to assist any other person or entity in doing so.
All curriculum, lesson plans, teaching methodologies, educational frameworks, assessment methodologies, instructional materials, educational content, educator training materials, operational procedures, quality assurance systems, learner evaluation systems, recordings, and related materials shall remain the exclusive property of Discover Urdu regardless of whether they are disclosed, demonstrated, shared, or otherwise made available in connection with the Services.
No license, ownership interest, intellectual property right, commercial right, or other proprietary interest is transferred to any Covered Individual, Parent or Learner except for the limited right to access Services in accordance with these Terms.
The obligations contained in this section shall survive termination of participation in the Services and shall continue for so long as the relevant information remains confidential, proprietary, protected by intellectual property rights, or otherwise protected under applicable law.
Discover Urdu reserves the right to pursue injunctive relief, equitable relief, monetary damages, recovery of profits, legal fees, costs, and any other remedies available under law or equity in connection with violations of this section.
To maintain quality, safety, safeguarding, training standards, operational continuity, educational improvement, dispute resolution, compliance, security, and other legitimate business purposes, Discover Urdu may record classes, lessons, meetings, calls, video sessions, and other interactions conducted through its Services.
Participation in Discover Urdu Services constitutes acknowledgment and consent to such recording. Participation in recorded sessions is a condition of receiving Services.
Covered Individuals, Parents, Learners, participants, and attendees may not independently record, photograph, capture, stream, reproduce, distribute, preserve, or otherwise create copies of any class, lesson, meeting, communication, or portion thereof without prior written authorization from Discover Urdu.
Requests for access to recordings should be submitted through an Authorized Communication Channel in accordance with Section 9.1. Access may be granted or denied at Discover Urdu’s sole discretion. Discover Urdu is under no obligation to provide access to recordings and may grant, restrict, revoke, suspend, limit, or deny access to recordings at its sole discretion. Access to recordings, where provided, may be subject to expiration periods, access controls, confidentiality obligations, usage restrictions, download restrictions, sharing restrictions, or other conditions determined by Discover Urdu.
Recordings are ordinarily retained for no longer than sixty (60) days. However, Discover Urdu may retain recordings longer where reasonably necessary for legal, regulatory, safeguarding, dispute resolution, quality assurance, staff training, operational, security, or other legitimate business purposes, or where required by law.
Where a session, meeting, communication, or interaction has already been recorded, subsequent withdrawal from the Services, cancellation of participation, termination of membership, revocation of consent, or other change in status shall not require Discover Urdu to delete, destroy, alter, or cease using such recording for lawful internal purposes permitted by these Terms.
Access to recordings is strictly limited to authorized personnel who require access for legitimate business purposes.
Discover Urdu will not use recordings containing a Learner, Parent, guardian, or participant for advertising, marketing, promotional activities, testimonials, social media, public websites, or other external-facing purposes unless prior explicit written permission has been obtained from the affected individual or, where the Learner is a minor, the Learner’s Parent or legal guardian.
Operational use of recordings for quality assurance, staff training, safeguarding, dispute resolution, compliance, educational improvement, internal review, and other legitimate business purposes does not require additional consent beyond acceptance of these Terms.
Discover Urdu shall not be responsible for incidental, background, unintended, accidental, or unavoidable capture of individuals, voices, images, screens, communications, surroundings, household members, participants, or other content that may occur during the ordinary operation of online educational services.
Covered Individuals, Parents and Learners are responsible for managing their physical environment, camera positioning, microphone settings, screen-sharing activities, background content, and other aspects of participation that may affect what is visible, audible, transmitted, displayed, or recorded during participation in the Services.
All recordings remain the exclusive property of Discover Urdu.
Discover Urdu may maintain attendance records, session logs, learner profiles, progress notes, educational observations, assessment records, communications records, scheduling records, placement records, and related documentation for educational, operational, safeguarding, quality assurance, compliance, training, administrative, and business purposes.
Discover Urdu reserves the right to determine the format, contents, retention periods, storage methods, review procedures, and internal use of such records.
Discover Urdu may archive, consolidate, anonymize, redact, summarize, modify, migrate, transfer, retain, delete, dispose of, or otherwise manage educational records in accordance with its operational requirements, business practices, legal obligations, safeguarding considerations, and record-management procedures.
Discover Urdu does not guarantee the preservation, availability, retrievability, completeness, or continued existence of any educational record for any particular period of time unless otherwise required by applicable law.
Educational records, internal notes, assessments, observations, evaluations, staff communications, quality assurance materials, and similar internal documentation may contain proprietary, confidential, operational, educational, or safeguarding information and may not be disclosed except where required by law or otherwise determined by Discover Urdu.
The maintenance of educational records does not create an obligation on Discover Urdu to provide copies of such records, assessments, observations, notes, or internal documentation unless required by applicable law.
If a Covered Individuals, Parent, Learner, or other user provides comments, feedback, suggestions, recommendations, testimonials, reviews, photographs, videos, communications, or other content to Discover Urdu (“User Content”), such User Content remains the property of its creator.
By submitting User Content to Discover Urdu, you grant Discover Urdu a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, modify, distribute, publish, and otherwise utilize such User Content for legitimate business purposes.

Discover Urdu reserves the right, but not the obligation, to review, monitor, remove, refuse, restrict, archive, edit, redact, modify, disable access to, preserve, disclose, investigate, or otherwise manage User Content at its sole discretion and without prior notice.
Your use of the Services is also governed by Discover Urdu’s Privacy Policy, which is incorporated into these Terms by reference.
By using the Services, you acknowledge that Discover Urdu may collect, use, store, process, transfer, disclose, and otherwise handle information in accordance with its Privacy Policy.
Where a conflict exists between these Terms and the Privacy Policy regarding privacy-related matters, the Privacy Policy shall govern to the extent of that conflict.
Nothing in these Terms or the Privacy Policy prevents Discover Urdu from using or disclosing information where reasonably necessary to investigate misconduct, respond to allegations, protect Discover Urdu or others, enforce these Terms, establish or defend legal claims, or otherwise as permitted or required by applicable law.
Covered Individuals, Parents and Learners are responsible for reviewing the Privacy Policy periodically for updates.
Discover Urdu reserves the right to update its Privacy Policy from time to time. Continued use of the Services following publication of an updated Privacy Policy constitutes acknowledgment of the revised policy.
Covered Individuals, Parents and Learners are responsible for reviewing the Privacy Policy periodically for updates. Discover Urdu may provide notice of material changes to the Privacy Policy where required by applicable law or where Discover Urdu otherwise determines appropriate; however, Discover Urdu is not obligated to provide individualized notice of every update.
Discover Urdu may utilize third-party providers for payments, communications, scheduling, hosting, security, analytics, video conferencing, customer relationship management, data storage, content delivery, automation, artificial intelligence systems, and other operational purposes.
Such providers may include, but are not limited to, payment processors, cloud hosting providers, communications platforms, learning platforms, analytics providers, security providers, and affiliated service providers.
Discover Urdu does not warrant, guarantee, endorse, control, monitor, supervise, or assume responsibility for the independent actions, omissions, policies, practices, availability, performance, security, reliability, data handling practices, decisions, content, functionality, or service interruptions of third-party providers.
Discover Urdu shall not be liable for losses, interruptions, delays, security incidents, data incidents, technical failures, service disruptions, performance issues, account restrictions, or other issues arising from the acts, omissions, failures, policies, decisions, or conduct of third-party providers except to the extent required by applicable law.
The use of third-party services may be subject to separate terms, conditions, and privacy policies maintained by those providers.
Where reasonably necessary to deliver Services, Discover Urdu may share information with third-party providers and affiliated entities in accordance with its Privacy Policy.
Discover Urdu may utilize technology-assisted systems, automation tools, artificial intelligence systems, educational software, analytics tools, machine learning systems, and similar technologies to support educational delivery, quality assurance, administrative functions, scheduling, communications, safeguarding, compliance, operational processes, and program improvement.
Such technologies may assist Discover Urdu personnel in performing educational, administrative, operational, quality assurance, customer service, scheduling, communications, and business functions.
Covered Individuals, Parents and Learners acknowledge that Discover Urdu’s use of technology-assisted systems, automation tools, artificial intelligence systems, machine learning systems, workflows, prompts, methodologies, configurations, models, processes, and related technologies may constitute proprietary, confidential, trade-secret, or competitively sensitive information of Discover Urdu and its service providers.
Technology-assisted systems, automation tools, artificial intelligence systems, machine learning systems, analytics tools, and similar technologies may generate recommendations, classifications, summaries, observations, scheduling suggestions, communications, educational information, administrative outputs, or other content that may contain inaccuracies, omissions, delays, limitations, or errors. Discover Urdu reserves the right to review, modify, supplement, disregard, rely upon, or otherwise manage such outputs in its sole discretion.
Nothing in these Terms shall be interpreted as creating an obligation for Discover Urdu to disclose the specific technologies, systems, methodologies, algorithms, prompts, workflows, models, processes, or tools used in connection with the Services.
Nothing in the Services creates any right to inspect, audit, access, test, review, evaluate, reproduce, analyze, reverse engineer, benchmark, or obtain information regarding Discover Urdu’s internal technology systems, operational workflows, automated processes, artificial intelligence systems, prompts, configurations, methodologies, or related business processes except where required by applicable law.
Discover Urdu reserves the right to modify, replace, expand, discontinue, or otherwise manage the technologies used in connection with the Services at any time.

Nothing in these Terms excludes any warranty or protection that cannot legally be excluded under applicable law.
To the fullest extent permitted by applicable law, Discover Urdu, its affiliates, related entities, officers, directors, employees, contractors, Educators, agents, representatives, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or speculative damages arising from or relating to:
The Services;
Participation in educational activities;
Communications;
Scheduling decisions;
Educator assignments;
Service interruptions;
Technical issues;
Data loss;

Third-party services; or
Any other matter relating to the Services.
To the fullest extent permitted by law, Discover Urdu’s total aggregate liability arising out of or relating to the Services shall not exceed the total amount actually paid by the Parent or Learner to Discover Urdu during the six (6) months immediately preceding the event giving rise to the claim.
For purposes of calculating any limitation of liability, only amounts actually received by Discover Urdu for the applicable Services shall be considered, excluding disputed payments, reversed transactions, chargebacks, refunded amounts, credits, promotional discounts, complimentary services, taxes, and third-party processing fees.
To the fullest extent permitted by law, any claim arising out of or relating to the Services must be commenced within six (6) months after the event giving rise to the claim.
To the fullest extent permitted by applicable law, where Discover Urdu elects to provide a credit, make-up session, replacement session, service extension, billing adjustment, alternative educational arrangement, or similar accommodation, such accommodation shall constitute the sole and exclusive remedy available to the Parent or Learner with respect to the circumstances giving rise to the accommodation.
The limitations contained in these Terms apply regardless of the legal theory asserted, including contract, tort, negligence, strict liability, statutory claims, or otherwise, and even if Discover Urdu has been advised of the possibility of such damages.
Some jurisdictions do not permit certain limitations of liability. In such jurisdictions, liability shall be limited to the maximum extent permitted by applicable law.
To the fullest extent permitted by applicable law, Covered Individuals, Parents and Learners agree to defend, indemnify, and hold harmless Discover Urdu, its affiliates, related entities, officers, directors, employees, contractors, Educators, agents, representatives, successors, and assigns from and against any claims, demands, actions, proceedings, liabilities, losses, damages, judgments, penalties, fines, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Any claim brought by a third party arising from participation in the Services.
Discover Urdu reserves the right to assume exclusive control of the defense and settlement of any matter subject to indemnification, and Covered Individuals, Parents and Learners agree to cooperate with such defense.
Covered Individuals, Parents and Learners are responsible for all activities conducted through their accounts and for any claims arising from the use of their accounts by authorized or unauthorized users acting through the account.
The indemnification obligations contained in this Section also apply to claims arising from alleged infringement, misappropriation, violation, or misuse of intellectual property rights, privacy rights, publicity rights, confidentiality obligations, contractual rights, or other rights caused by the Covered Individuals, Parent, Learner, User Content, or activities conducted through the account.
To the fullest extent permitted by applicable law, the parties knowingly and voluntarily waive any right to a trial by jury in connection with any dispute, claim, action, or proceeding arising out of or relating to the Services or these Terms.
Parents should direct billing concerns through an Authorized Communication Channel in accordance with Section 9.1 before initiating chargebacks or payment disputes.
Discover Urdu reserves the right to suspend, restrict, or terminate access to Services if a payment is declined, reversed, disputed, charged back, refunded through a financial institution, or otherwise fails to settle successfully.
Discover Urdu may attempt to reprocess failed payments, contact the Parent regarding outstanding balances, or provide an opportunity to update payment information, but is under no obligation to do so before suspending Services.
To the fullest extent permitted by applicable law, Discover Urdu reserves the right to recover unpaid fees, chargeback fees, payment processing fees, administrative costs, collection costs, professional fees, legal fees, and other reasonable expenses arising from failed payments, chargebacks, payment disputes, payment reversals, collection efforts, or enforcement of these Terms.
Membership fees, subscription fees, and other charges remain due and payable unless expressly waived by Discover Urdu in writing.
Initiating a chargeback, payment dispute, payment reversal, or similar action does not automatically relieve a Parent or Learner of contractual obligations under these Terms.
Resolution of a failed payment, chargeback, payment dispute, or payment reversal does not obligate Discover Urdu to restore a prior schedule, Educator assignment, class placement, enrollment status, membership structure, promotional pricing, grandfathered pricing, or program placement.
Where a chargeback, payment dispute, or payment reversal is initiated, Discover Urdu reserves the right to:
Suspend participation in Services;
Restrict access to accounts;
Deny future enrollment;

Discover Urdu makes no representation that the Services are appropriate, lawful, or available in every jurisdiction.
Accessing or using the Services from a jurisdiction where such access or use is prohibited is done at the user’s own risk.

Certain Services, including camps, workshops, special events, assessments, enrichment activities, promotional programs, pilot programs, community events, or other offerings, may be subject to separate policies, pricing structures, schedules, cancellation rules, refund provisions, eligibility requirements, participation requirements, or operational procedures.
Where such additional policies exist, they shall supplement these Terms.
In the event of a conflict between these Terms and a specific policy governing a particular program, the specific program policy shall control with respect to that program unless otherwise stated.
Discover Urdu reserves the right to modify, suspend, discontinue, postpone, combine, restructure, or cancel special programs at any time.
Participation in a special program may require acceptance of additional agreements, waivers, disclosures, eligibility requirements, participation conditions, operational procedures, or program-specific terms designated by Discover Urdu.

Discover Urdu reserves the right to investigate actual or suspected violations of these Terms and may review communications, records, recordings, account activity, participation history, scheduling information, and other information reasonably available to Discover Urdu in connection with such investigations, subject to applicable law and the Privacy Policy.
Where reasonably necessary to protect individuals, investigate concerns, resolve disputes, ensure compliance, maintain quality standards, or preserve the integrity of the Services, Discover Urdu may review communications, attendance records, educational records, scheduling records, account activity, recordings, and other information available to it, subject to applicable law and its Privacy Policy.

Upon suspension, restriction, termination, refusal, or discontinuation of participation, Discover Urdu may immediately disable access to accounts, communications, educational materials, recordings, reports, scheduling systems, memberships, subscriptions, program resources, and other aspects of the Services.

Discover Urdu reserves the right to modify, amend, supplement, replace, or otherwise update these Terms from time to time.
Updated Terms shall become effective upon publication on Discover Urdu’s website or through other reasonable notice provided by Discover Urdu.

Discover Urdu may investigate the matter and may review communications, attendance records, billing records, educational records, recordings, account activity, scheduling information, and other information reasonably relevant to the dispute, subject to applicable law and the Privacy Policy.
The parties agree to cooperate reasonably during the informal-resolution process and to provide information reasonably necessary to evaluate the matter.
Nothing in this Section requires Discover Urdu to provide refunds, credits, compensation, accommodations, waivers, exceptions, admissions of liability, or any particular resolution.
Nothing in this Section prevents either party from seeking temporary, preliminary, emergency, injunctive, equitable, or other relief where immediate action is reasonably necessary to protect legal rights, confidential information, intellectual property, safety, security, or other legitimate interests.
Failure by Discover Urdu to resolve a dispute informally shall not constitute an admission of liability, fault, wrongdoing, responsibility, or waiver of any rights, defenses, limitations, protections, or remedies available under these Terms or applicable law.
The informal-resolution process described in this Section is intended to encourage good-faith resolution of disputes and shall be interpreted consistently with applicable law.
These Terms and any dispute, claim, controversy, or proceeding arising out of or relating to the Services, these Terms, or the relationship between the parties shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States of America, without regard to conflict-of-law principles.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms.
The failure of Discover Urdu to enforce any provision of these Terms, exercise any right, or take action with respect to any violation shall not constitute a waiver of that provision, right, or violation.
Any waiver by Discover Urdu must be in writing and signed by an authorized representative of Discover Urdu.
No waiver of any breach or violation shall be deemed a waiver of any subsequent breach or violation.
Nothing in this Section limits the authority provisions contained in Section 9.3, which continue to govern who may bind Discover Urdu or modify these Terms.
These Terms, together with the Privacy Policy and any program-specific policies expressly incorporated by reference, constitute the entire agreement between Discover Urdu and the Covered Individual, Parent or Learner regarding the Services.
